Case 124 of 2015.   Petitioner/husband has handed over the power to conduct the said case on behalf of him to his concerned Ld. Advocate as it would be difficult for him to conduct the case by appearing physically on each and every date due to  the long distance between his residence and the Court.  Allegedly the said concerned Ld.   Easy matter 4 One day, an old fox was sitting near a river bank. A goat came there to drink water. The fox asked the goat to give him some water to drink. The goat took mercy on him and came near him with water. But the fox was very wicked, he attacked her. The goat was very strong, she escaped from there. After a few minutes, a deer came there to quench his thirst. The fox tried to attack him too, but the deer was very swift and strong, he also escaped. Thereafter, a sheep came there grazing. The wicked fox tried to trap the sheep. But the sheep said, "You wicked fox! You better die in thirst. Though your condition is so miserable, you are not out of your wickedness. I saw you trapping the goat and the deer. I will not fall prey to you.' Saying this, she ran away swiftly. Moral: Always be tactful with the wicked people.

  Legal Matter 4 Seen the petition of complaint and the prosecution report along with forwarding report, arrest memo., personal search, inspection memo., statement of accused and medical slip filed by the R.P.F.   Legal Matter 3. The petitioner has claimed pre-emption on the ground of Co-ownership as well by virtue of being a contiguous land owner. My foregoing discussions categotically reveal that the petitioner is a co-sharer as well as a contiguous land owner. Section 8 of the W.B.L.R. Act, 1955 mandates that the notified co-sharers are required to apply for preemption as co-sharers within a period of three months of the transfer of land from the date of service of notice.               The Hon'ble Court, in Adhir Kumar Guchait vs. Maya Rani Ma jhi reported in 2009 (4) CHN 597 , expounded that Section 5(5) of the West Bengal Land Reforms Act, 1955 does not contemplate service of notice upon the adjoining land owner. It is also not provided in the said Act that the adjoining land owner will get benefit in case of non-service.
